PUNCH media disclaims any and all liability for the acts, omissions and conduct of any third party users, advertisers and/or sponsors on the Websites, in connection with PUNCH media programs or otherwise related to your use of the Websites.

We doe not promise that the Websites will be error-free, uninterrupted or provide specific results from use of the Websites or any content, search or link on it.

PUNCH media will not be liable for any damages of any kind arising from the use of these Websites or any PUNCH media products or services, including without limitation, direct, indirect, incidental, punitive and consequential damages.

In the event a product/program listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information, PUNCH media shall have the right to refuse or cancel any orders placed for what has been listed at the incorrect price.

PUNCH media shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and payment has been made from your account. If your account has already been charged for the purchase and your order is canceled, PUNCH media shall immediately issue a credit to or refund your account in the amount of the charge.

All website graphical design, text and graphics are property of PUNCH media or its content suppliers and is protected by Canadian and international copyright laws. Any use of PUNCH media logo, SocialMediaEschool logo or contents of the Websites requires prior written consent of PUNCH media.

The Websites content and software may be used as a resource. Any other use, including reproduction, modification, distribution, transmission, republication, display, or public performance, is strictly prohibited. All rights reserved.

Anyone who purchases products/services on our Websites may receive access to private content not available to general visitors.

Unless otherwise noted, you may access and use the information and materials within our websites for your personal use. You may not change, modify, delete, display, transmit, adapt, exploit, or copy for distribution or sale any information, material, trademark, or copyright found on our websites.

3. USERNAMES & PASSWORDS

If you purchase one of PUNCH media’s services or products you may be required to create an account and provide us with your email address. You may be required to set up a username (“Username”) and a password (“Password”), as well as other information.

When creating your account, you must provide current, accurate, and complete information. Each Username and Password can be used by only one person. Unless otherwise noted, sharing your access credentials with others is a breach of the Terms and Conditions of this Agreement. You are solely responsible for the confidentiality and use of your Username, Password, email address and for any use, misuse, or communications entered through our Websites using them.

We reserve the right to delete or change your Username and Password at any time and for any reason. PUNCH media and shall have no liability to you for any loss or damage caused for any changes or for unauthorized use of your account.

If you are a part of any PUNCH media online community, you agree to comply with the following community guidelines (the “Community Guidelines”) as well as any and all applicable laws.

You will not use our Websites for any unlawful purpose including uploading, posting, emailing or sharing:

content that is indecent, obscene, defamatory, libelous, sexually explicit, promotes violence or hate speech

5. FEES AND PAYMENT

The receipt of an electronic or other form of order confirmation does not signify PUNCH media’s acceptance of your order, it only reflects our acknowledgment of your request for access to the product(s). PUNCH media reserves the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order.

By making a purchase on the Websites, you agree that you are at least 19 years of age.

For any purchase you make on the Websites, you will pay PUNCH media all applicable fees and taxes. PUNCH media (or our third-party payment processor) shall authorize your credit card, PayPal, Square or or other approved form of payment for the full payment of the fees and any applicable taxes.

All payments will be charged in U.S. dollars unless specified otherwise. The third-party payment processor, not PUNCH media, is responsible for converting the payment to your local currency. You agree to indemnify PUNCH media of any liability or errors made by any third-party payment processors.

All billing information must be kept up-to-date, and you must promptly contact us if your credit card is lost or stolen. PUNCH media reserves the right to charge any renewal card issued to you to the same extent as the expired card. If payment is not received from your credit card issuer, you agree to pay all amounts due upon request.

PUNCH media is not responsible for orders that take longer than the estimated times. If you have not received your product within 48 hours you have an obligation to notify PUNCH media in writing at [email protected].

Once you place your order on PUNCH media website (www.punchmedia.ca or socialmediaeschool.com), you (customer) have electronically signed an agreement and have 48 hours to contact us about any mistakes, discrepancies, or questions about your purchase.

If there is any outstanding balance requiring collection, you agree to pay all costs of collection, including attorney’s fees and costs in addition to the outstanding amount. The issuer of your credit card or payment processor may charge you a foreign transaction fee or related charges, which you will be responsible to pay. Please be sure to check with your bank and credit card issuer for details.

6. REFUND POLICY

There is a sixty (60) day refund policy for PUNCH media products and services. To be eligible for a full refund, you must submit your request by 11:59pm Eastern Time within 60 days of product purchase regardless of whether you started the program or not.

7. INTELLECTUAL PROPERTY

The Websites contain material, including videos, workbooks, blueprints, training modules, photographs, software, images, graphics text, audio recordings, and other material provided by PUNCH media or their partners (collectively referred to as the “Content”). The Content is protected under the laws of Ontario, Canada as well as all foreign laws. Unauthorized use of the Content may violate copyright, trademark, and other laws.

Visitors may view all publicly-available Content for their own personal, non-commercial use.

Product Purchasers, may download and view any Content for their own personal, non-commercial use.

You will not use any Content except as permitted through written consent by PUNCH media.

PUNCH media retains all intellectual property rights to the Content. You may not sell, transfer, assign, license, modify, reproduce, display, distribute, or otherwise use the Content in any way for any public or commercial purpose.

8. LIMITATION OF LIABILITY & INDEMNIFICATION

PUNCH media does our very best to ensure all Content and Websites are up-to-date and error-free. We routinely and regularly update our site, our server and material to ensure there are no viruses.

Should there be any delays, interruptions from any cause whatsoever, you will not hold PUNCH media responsible for any damages (direct, indirect, incidental, consequential, lost profits, lost data or business interruption).

By using any Content on these Websites (paid programs or otherwise), you agree that PUNCH media and our employees, agents, successors, and affiliates will be held harmless from and against any damages, liabilities, losses, expenses, claims, and actions, including reasonable legal and accounting fees.
